The problem
German tenancy law is strictly tenant-friendly: rent out an apartment without the right contract form and you can quickly be locked into an indefinite tenancy. Good to know — German legal situation
- Housing for temporary use (sec. 549 (2) no. 1 BGB) is exempt from the strict tenant protection rules — but the purpose of stay must be properly documented.
- The deposit is capped at three months' net rent (sec. 551 BGB); tenant terminations require written form and a three-month notice period (secs. 568, 573c BGB).
- After every move-in, the tenant needs the landlord's confirmation for the registration office within two weeks (sec. 19 BMG).
