Frequently asked questions

Can the warranty be excluded in a private sale?
Often yes, within limits. Austria: in a sale between private individuals the statutory warranty may be fully excluded by agreement — ABGB § 929 (iVm § 922), as of 2026 — but fraudulently concealed defects and expressly assured qualities remain covered — ABGB § 928, as of 2026. France: a seller may exclude the warranty for hidden defects by express clause — Code civil art. 1643, as of 1804. Spain: the hidden-defect warranty may be excluded by agreement provided the seller was unaware of the defects — Código Civil art. 1485, as of 1889.
How long can a buyer claim for defects?
Germany: two years — BGB § 438 Abs. 1 Nr. 3, as of 2002 — starting on delivery of the item — BGB § 438 Abs. 2, as of 2002. Austria: two years for movable goods after handover — ABGB § 933 Abs 1, as of 2026. France: two years from discovery of the defect — Code civil art. 1648 al. 1, as of 2005.
Who bears the risk if the item is damaged after the sale?
Germany: the risk of accidental loss and deterioration passes to the buyer on handover — BGB § 446 S. 1, as of 2002. Austria: the risk passes on handover as well — ABGB § 1064 iVm § 1048, as of 2026. Thailand: under a contract to transfer a specific item, the buyer as creditor bears the risk where the loss is not attributable to the seller — Civil and Commercial Code Section 370, as of 1925.
What does the private purchase agreement cover?
The document (Purchase Agreement for a Used Item, Private Sale) is divided into these sections: § 1 Item Sold; § 2 Purchase Price and Handover; § 3 Exclusion of Warranty; § 4 Place, Date and Signatures.
Is this legal advice?
No. The information here is general, and the product is a document generator. For your specific case, you should consult a lawyer.

Why DUOLEXX instead of just asking an AI?

An AI writes text fast. That doesn't make it legally sound, bilingual and ready to sign. That's exactly the difference.

Grounded in local law

Every document follows the law of the chosen country — researched clauses, not a generic template from the web.

Authoritative language + translation

The binding version in the legal language, alongside an understandable translation. A chat rarely delivers both, soundly, at once.

Verifiable signature

Two-party signature with a SHA-256 integrity proof — provable that both signed the same wording.

Finished, not just text

PDF, signature, archive and share link in one flow — an AI chat only hands back raw text.
