What happens if I sublet without permission?
It depends on the country. Spain: subletting without the landlord's consent is a statutory ground for terminating the lease — LAU art. 27.2.c, as of 1995. Austria: if the whole dwelling is passed on without an urgent need, or let for a disproportionately high consideration, the landlord has a ground for termination — MRG § 30 Abs 2 Z 4, as of 2026.
How much sublease rent may I charge?
Austria: for a fully sublet dwelling, at most 50 percent above the main rent lawfully owed — MRG § 26 Abs 1, as of 2026. Portugal: at most 20 percent above the proportional share of the main rent — Código Civil art. 1062.º, as of 1967. France: per square metre, no more than the main tenant pays — loi n° 89-462 art. 8, as of 2014.
Do I need the landlord's permission to sublet?
Germany: yes, a tenant may not sublet without the landlord's permission — § 540 Abs. 1 S. 1 BGB, as of 2001. A residential tenant can require that permission once a legitimate interest arises after the lease was concluded — § 553 Abs. 1 S. 1 BGB, as of 2001.
Does a sublease have to be in writing?
It depends on the country. Cyprus: a contract relating to immovable property for more than one year must be in writing and signed before two competent witnesses — Contract Law, Cap. 149 Art. 77(1), as of 2026.
