What applies if the car shows a defect shortly after purchase?
When a consumer buys from a trader, the seller is liable for defects that become apparent within two years of delivery — Directive (EU) 2019/771 Art. 10(1), as of 2022. If the defect appears within the first year, it is presumed to have existed at delivery unless proved otherwise — Art. 11(1), as of 2022.
Does the legal guarantee also apply to a private sale?
The two-year minimum guarantee covers sales from a trader to a consumer, not purely private sales — Directive (EU) 2019/771 Art. 10(1), as of 2022. The document contains its own clause on the condition of the vehicle (Condition — Sold as Seen).
Can I withdraw from a vehicle I bought online from a dealer?
A consumer has 14 days to withdraw from a distance or off-premises contract without giving any reason; the Article 16 exceptions remain reserved — Directive 2011/83/EU Art. 9(1), as of 2014.
Which law applies to a cross-border vehicle purchase?
The parties may freely choose the governing law — Rome I Regulation (EC) No 593/2008 Art. 3(1), as of 2009. Without a choice, the law of the seller's country of habitual residence applies — Art. 4(1)(a), as of 2009. For consumers, the choice may not remove the mandatory protection of their home country — Art. 6(2), as of 2009.
