How much can the landlord ask for as a guarantee?
The deposit is fixed at one month's rent (LAU art. 36.1), and any additional guarantee is capped at two months' rent for leases up to 5 years, or 7 if the landlord is a legal entity (LAU art. 36.5, since 2019).
When do I get my deposit back?
The landlord must return the deposit balance after handover; if it is not returned within one month of you handing over the keys, it starts earning statutory interest in your favour (LAU art. 36.4).
Can the landlord raise the deposit during the contract?
No — during the mandatory extension years the fianza may not be updated (LAU art. 36.2).
What is the minimum length of the lease?
A residential lease has a mandatory minimum term of 5 years when the landlord is an individual, rising to 7 years if the landlord is a legal entity (LAU art. 9.1, since 2019).
What is the difference between the deposit (fianza) and an additional guarantee?
The fianza is the mandatory legal deposit of one month's rent (LAU art. 36.1); an additional guarantee is any extra security the landlord asks for, capped at two months' rent for leases up to 5/7 years (LAU art. 36.5).
