What am I liable for as guarantor of a Portuguese tenancy?
The guarantor answers for the tenant's rent debts and, on default, for a statutory indemnity of 20% of the amount owed, unless the contract is terminated for non-payment — Código Civil art. 1041.º, n.º 1 (as of 2019).
Must the landlord tell me if the tenant stops paying?
Yes — where a guarantee exists, the landlord must notify the guarantor of the default and the sums owed within 90 days — Código Civil art. 1041.º, n.º 5 (as of 2019).
Does the guarantee have to be in writing?
Yes — the urban tenancy must be in writing and the fiança declaration takes the same form — Código Civil art. 1069.º (as of 2006).
Can I be liable for damage to the property?
If the initial state is not documented, the law presumes the property was handed over in a good state of conservation, so restoration costs can fall on the guarantor — Código Civil art. 1043.º, n.º 2 (as of 1967).
How long does the guarantee last at minimum?
A tenancy for permanent housing has a minimum term of 1 year, which sets the minimum span the guarantee may run — Código Civil art. 1095.º, n.º 2 (as of 2019).
