What happens if we don't record the condition at handover?
Absent proof of the initial state, the law presumes the property was delivered in a good state of maintenance and conservation — the tenant then has to prove any pre-existing damage and may otherwise be liable for later damage (Código Civil art. 1043.º, n.º 2, as of 1967). A detailed protocol with photos is your protection.
Does the handover protocol have to be in writing?
An urban tenancy must be concluded in writing (Código Civil art. 1069.º, as of 2006). Keep the handover protocol in writing too and have both sides sign it, so it forms part of the contract.
We signed an English and a Portuguese version — which one counts?
If the language versions diverge, the Portuguese version prevails (Código Civil / NRAU, Lei n.º 6/2006). Read the Portuguese text closely before signing.
Where is a dispute about the condition decided?
The competent court is the one for the place where the property is located, the tribunal da situação do locado (Código Civil / NRAU, Lei n.º 6/2006).
