Frequently asked questions

Will I get my deposit back after the handover?
Yes — once you return the flat, the deposit plus interest must be repaid without delay, unless the landlord uses it for justified claims from the tenancy (MRG § 16b Abs 2). Anything withheld without cause can be reclaimed (§ 1435 ABGB).
Do I have to pay for normal signs of use?
No — you only owe the flat in the condition you received it; ordinary wear from contractual use need not be compensated (ABGB § 1109). That is exactly why a handover protocol records the condition.
Who owns the interest on the deposit?
You do — a cash deposit must be invested fruitfully and kept separate, and the investment interest belongs to the tenant; excluding it is not permitted (MRG § 16b Abs 1).
Who must fix damage I did not cause?
The landlord must hand over and maintain the flat in usable condition at their own cost; if it becomes unusable through no fault of yours, the rent is reduced pro rata (ABGB § 1096 Abs 1).
Is there a statutory cap on the deposit in Austria?
No — the MRG names no figure; the limit comes only from immorality (§ 879 ABGB), with around three gross monthly rents being customary (MRG § 16b).
