How long can a fixed-term second-home let run before the MRG fully applies?
For a temporary change of location caused by employment, the full exemption from the MRG applies for at most six months; if that period is exceeded, the MRG may become applicable (§ 1 Abs 2 Z 3 lit b MRG, Stand: 2026).
What registration duties apply on moving in and out?
Registration must be completed within three days of taking up the accommodation (§ 3 Abs 1 MeldeG) and de-registration within three days of giving it up (§ 4 Abs 1 MeldeG). The accommodation provider is obliged to sign the registration form (§ 8 Abs 1 MeldeG).
Is there a minimum fixed term when the MRG applies?
For residential tenancies within the MRG's scope, the minimum fixed term is three years for private (non-commercial) landlords; for business landlords it was raised from three to five years by the Mietenpaket 2026, effective 1 April 2026 (§ 29 Abs 1 Z 3 MRG, Stand: 2026).
How is the deposit regulated – and is this legal advice?
The MRG sets no numerical cap on the deposit (§ 16b MRG); a cash deposit must be invested to bear interest and repaid without delay once the property has been returned (§ 16b Abs 1 und 2 MRG). This information is for general guidance only and is not legal advice.
