Can I terminate a fixed-term tenancy early?

Yes. Under a fixed-term residential tenancy, the tenant may give notice at the earliest after one year of the contract term has elapsed, with a three-month notice period to the last day of the month (§ 29 Abs 2 MRG, Stand: 2026).

What notice period applies to an open-ended tenancy?

The tenant's ordinary notice period is one month to the last day of the month (§ 33 Abs 1 MRG iVm § 560 ZPO, Stand: 2026).

Can the early-termination right under a fixed-term contract be excluded?

No. The tenant's right to give notice after the first year has elapsed is mandatory and cannot validly be excluded by contract (§ 29 Abs 2 MRG, Stand: 2026).

On what date does the notice take effect – and is this legal advice?
