What notice period applies to the tenant?
The tenant's ordinary notice period is three months (§ 573c Abs. 1 S. 1 BGB). For a month to count, the notice must be received by the third working day of that month; it then takes effect at the end of the month after next. This is general information (as of 2001) and not legal advice.
In what form must the termination be given?
Termination of a residential lease requires written form (Schriftform) and must be personally signed (§ 568 Abs. 1 BGB). A termination sent only by email does not satisfy the written-form requirement. (as of 2001)
What happens if the notice is received after the third working day?
If the notice reaches the landlord only after the third working day of a month, that month no longer counts; the three-month period then starts in the following month (§ 573c Abs. 1 S. 1 BGB). (as of 2001)
Do these rules also apply to housing for temporary use?
No: residential space let only for temporary use is exempt from the tenant-protection provisions that govern residential tenancies of indefinite duration (§ 549 Abs. 2 Nr. 1 BGB). (as of 2001)
