Frequently asked questions

Does a power of attorney in Germany have to be notarised?

Generally no: it is form-free and a private written document usually suffices (BGB § 167 Abs. 2). But transactions to buy or sell real estate require notarial recording (BGB § 311b Abs. 1 S. 1), so a private power of attorney is not enough there.

Can I revoke a power of attorney I have granted?

Yes. A power of attorney is revocable at any time, even while the underlying relationship continues, unless that relationship provides otherwise (BGB § 168 S. 2).

Why should my agent carry the original power-of-attorney document?

For a unilateral legal act, if the agent does not present the document the other party may reject the act without undue delay, making it invalid (BGB § 174 S. 1). Presenting the document also counts as notice of the authorisation (BGB § 172 Abs. 1).

Can someone disclaim an inheritance for me using a power of attorney?

Only in the proper form: the disclaimer must be declared to the probate court, recorded in its minutes or given in officially certified form (BGB § 1945 Abs. 1). A simple private power of attorney does not suffice.

Am I bound by what my agent does?

Yes. A declaration the agent makes in your name within the scope of authority takes direct effect for and against you as the principal (BGB § 164 Abs. 1).
