Frequently asked questions

Can my agent sell or mortgage my Thai property with a general power of attorney?
No — selling or mortgaging immovable property, making a gift, compromising, litigating or arbitrating fall outside a general agent's authority and require express, itemised authority (Civil and Commercial Code s. 801).
What happens if my agent acts beyond the power of attorney?
The act binds you only if you ratify it; if you do not, the agent is personally liable to the third party — unless that party knew the agent lacked authority (Civil and Commercial Code s. 823).
Does the power of attorney have to be in writing?
If the underlying transaction is legally required to be in writing, the power of attorney for it must also be in writing; for acts before authorities such as the Land Department an itemised written POA is needed (Civil and Commercial Code s. 798).
Can I revoke the power of attorney at any time?
Yes, you may revoke it at any time (and the agent may renounce it); but revoking it at an inconvenient time, save unavoidable necessity, makes you liable for any resulting injury (Civil and Commercial Code s. 827).
Does the power of attorney end if I die or become incapacitated?
Yes — it is extinguished on the death, incapacity or bankruptcy of either principal or agent, unless the terms of the agreement or the nature of the business provide otherwise (Civil and Commercial Code s. 826).
Can my agent grant a lease of my property?
A general power of attorney does not cover letting immovable property for more than 3 years; a longer lease requires express authority (Civil and Commercial Code s. 801(2)).
