This document consists of two language versions. In the event of any discrepancy or question of interpretation, the version in the governing legal language (English) shall prevail; the ไทย version is a translation provided for convenience.

Frequently asked questions

Am I liable without limit, like a joint debtor?
No. A clause making a natural-person surety liable in the capacity of a joint debtor is void (CCC s. 681/1, as of 2015), and liability can be capped at a defined maximum amount (CCC s. 681, as of 2015).
Am I discharged if the landlord misses a deadline?
Yes. On the tenant's default the landlord must notify the surety in writing within 60 days; failing that, the surety is discharged — CCC s. 686, as of 2015.
Does the guarantee have to be in writing?
Yes. A suretyship is enforceable by action only if there is written evidence signed by the surety — CCC s. 680 para. 2, as of 2015.
When can the landlord terminate for non-payment?
Only after giving the tenant at least 15 days to pay, which the landlord must allow before terminating — CCC s. 560.
What is the maximum security deposit?
A controlled residential-leasing business may collect at most 1 month's rent as a deposit — Contract-Controlled Business Notification B.E. 2561, cl. 4, as of 2018.
