What am I liable for as guarantor?
A guarantor's liability is co-extensive with the tenant's: in principle you are liable for the same amounts and obligations as the tenant, unless the contract expressly limits it — Contract Law, Cap. 149 s. 86.
Is an oral guarantee valid?
Yes, it can be binding. The Contract Law, Cap. 149 imposes no written-form requirement for a guarantee's validity; under ss. 84-85 an oral guarantee may bind.
What can be deducted from the deposit?
Only the actual loss from the tenant's breach that was foreseeable when the contract was made. No penalty may be retained — Contract Law, Cap. 149 ss. 73-75.
What notice must the tenant give?
If the agreement sets no period, the tenant's written notice to quit must be at least one month — Rent Control Law 23/1983 s. 11(2).
Must the guarantee or lease be in writing?
Contracts over immovable property for a term exceeding one year must be made in writing and signed by the parties before two competent witnesses — Contract Law, Cap. 149 Art. 77(1).
In what condition must the property be returned?
In the condition in which it was received, fair wear and tear excepted — Rent Control Law 23/1983 s. 27.
