Frequently asked questions

Can the landlord keep my deposit for handover damage?

Only up to the actual, reasonably foreseeable loss; no penalty may be retained (Contract Law, Cap. 149, ss. 73–75), and only for damage beyond fair wear and tear (Rent Control Law 23/1983, s. 27).

Do I have to fix normal signs of use?

No. You return the premises in the condition received, with fair wear and tear expressly excepted — Rent Control Law 23/1983, s. 27.

Is my guarantor liable if handover damage exceeds the deposit?

Yes. The guarantor's liability is in principle co-extensive with the tenant's, save as limited by the contract — Contract Law, Cap. 149, s. 86.

How much notice do I owe around the handover?

If the agreement stipulates none, the tenant's written notice to quit must be not less than one month — Rent Control Law 23/1983, s. 11(2).

Where do we go if we cannot agree on the deposit?

For a free-market tenancy the District Court where the premises are located decides (Courts of Justice Law 14/1960); the tenancy itself is governed by the Contract Law, Cap. 149.
