Can the landlord keep my deposit for damage that was already there when I moved in?
Only if you can't prove otherwise: absent a documented statement of condition, the law presumes you received the property in good condition, so document every defect at handover — Código Civil art. 1562.
How long does the landlord have to return my deposit?
The returnable deposit balance starts accruing statutory interest once one month has passed since you handed over the keys without it being repaid — LAU art. 36.4.
How much deposit can the landlord legally require?
For a residential lease the statutory deposit is one month's rent — LAU art. 36.1.
Can the landlord ask for extra security beyond the deposit?
Yes, but any additional guarantee is capped at two months' rent for leases up to 5 years (7 if the landlord is a legal person) — LAU art. 36.5.
