This document consists of two language versions. In the event of any discrepancy or question of interpretation, the version in the governing legal language (English) shall prevail; the ไทย version is a translation provided for convenience.

Frequently asked questions

Will I get my deposit back, and when?
Yes. An operator letting 5+ residential units must return the deposit within 7 days after the lease ends and the property is returned without damage (Notification B.E. 2561 (2018), cl. 4, as of 2018). Nothing may be withheld for ordinary wear and tear (Civil and Commercial Code s. 562).
How do I terminate correctly as a tenant?
For a controlled residential lease you must give at least 30 days' written notice (Notification B.E. 2561 (2018), cl. 4, as of 2018). If the lease has no fixed term, you may terminate at the end of a rent period, and never more than 2 months' notice can be required (Civil and Commercial Code s. 566).
Do I even have to give notice on a fixed-term lease?
No. A fixed-term lease is extinguished automatically at the end of the agreed period, without any notice of termination (Civil and Commercial Code s. 564).
Can the landlord terminate me immediately for late rent?
No. For monthly rent, the landlord must first give you at least 15 days' notice to pay before terminating for non-payment (Civil and Commercial Code s. 560).
Can my deposit be cut for damage at move-out?
You are not liable for ordinary wear and tear (Civil and Commercial Code s. 562). But watch out: without a handover condition list you are presumed to have received the property in good condition and must return it that way (Civil and Commercial Code s. 561) — so document the condition at move-in and move-out.
