How high can the security deposit be for a rental flat in Germany?
The deposit is limited to three months' net cold rent (§ 551 Abs. 1 BGB). The tenant may pay it in three equal monthly installments (§ 551 Abs. 2 BGB), the first at the start of the tenancy. A cash deposit must be held by the landlord separately and in an interest-bearing account (§ 551 Abs. 3 BGB). (as of 2001)
What notice period applies to the lease?
For the tenant the ordinary notice period is three months, and notice must be received by the third working day of a month (§ 573c Abs. 1 S. 1 BGB). For the landlord it extends to six months after more than five years and to nine months after more than eight years (§ 573c Abs. 1 S. 2 BGB). Termination requires written form (§ 568 Abs. 1 BGB). Do I have to register in Germany, and who provides the confirmation?
Anyone moving into a dwelling must register with the registration office within two weeks (§ 17 Abs. 1 BMG). The landlord (dwelling provider) is legally obliged to issue the move-in confirmation within two weeks (§ 19 Abs. 1 BMG). (as of 2015)
Do the same protection rules apply to housing for temporary use?
No: residential space let only for temporary use is exempt from the tenant-protection provisions that govern residential tenancies of indefinite duration (§ 549 Abs. 2 Nr. 1 BGB). (as of 2001)
