What happens to my fee if the client cancels the project?
If performance fails because of circumstances on the client's side, you still keep the agreed fee, but you must credit what you saved or earned elsewhere as a result, or deliberately failed to earn — § 1168 Abs 1 ABGB, as of 2026.
When is my fee due — can I invoice before the work is finished?
As a rule the fee is payable only once the work is completed; but where the work is done in stages or involves outlays you did not assume, you may demand a proportionate part of the fee and reimbursement of outlays in advance — § 1170 ABGB, as of 2026.
Am I covered by social security as a free service contractor, and who pays the contributions?
Free service contractors are placed on an equal footing with employees and are compulsorily insured under the ASVG where they undertake to render services essentially in person, without significant own operating resources, and are not already covered under GSVG/BSVG/FSVG — § 4 Abs 4 ASVG, as of 2026.
What distinguishes a contract for work (Werkvertrag) from a free service contract?
A contract for work owes a defined result, so the fee falls due only on completion of the work (§ 1170 ABGB), whereas a free service contractor owes ongoing, essentially personal services and is insured like an employee under the ASVG (§ 4 Abs 4 ASVG) — as of 2026.
