Frequently asked questions

How much deposit can a landlord demand in Austria?

The MRG sets no numerical ceiling; about three gross monthly rents is customary, and excessive amounts can only be challenged as contrary to public morals (§ 879 ABGB). The landlord must invest a cash deposit profitably, and the interest belongs to you (§ 16b MRG).

What happens if I miss the registration deadline?

You must register with the registration office within three days of moving in (§ 3 Abs 1 MeldeG). Failing to do so is an administrative offence and can be punished with a fine of up to 726 euros even on the first occasion (§ 22 Abs 1 MeldeG).

Can I exclude the warranty in a private sale?

Yes, a full warranty exclusion is permitted between private individuals (§ 929 in conjunction with § 922 ABGB). It does not cover fraudulently concealed defects or expressly assured qualities, however — for those the seller remains liable (§ 928 ABGB).

I have a fixed-term lease — can I get out early?

With a fixed-term residential lease under the MRG you can give notice at the earliest after one year of the agreed term has elapsed (§ 29 Abs 2 MRG); this right cannot be contracted away.

Does my employer have to pay extra for overtime?

Yes. Overtime attracts a 50% premium on the hourly wage or compensation by time off in lieu (§ 10 Abs 1 AZG).

Can the landlord simply terminate my lease?

Within the scope of the MRG the landlord can only terminate through the court, whereas you as the tenant may terminate in writing or through the court (§ 33 Abs 1 MRG).
